General Terms and Conditions (GTC) of Noahkis Apartments GbR Mittelstraße 24, 56133 Fachbach Represented by the managing directors Lena and Nabil Faddoul 1. Scope These General Terms and Conditions apply to all contracts for the temporary rental of the holiday apartment by Noahkis Apartments GbR (hereinafter "landlord") to guests (hereinafter "tenant") as well as all associated other services and deliveries. Deviating conditions of the tenant are not recognized unless the landlord expressly agrees to their validity in writing. 2. Conclusion of contract A rental contract is concluded when the landlord confirms the tenant's booking in writing, electronically or by telephone. The booking is binding as soon as the booking confirmation has been sent by the landlord. 3. Payment The total amount for the rent must be paid no later than 7 days before arrival, unless otherwise agreed. For short-term bookings (less than 7 days before arrival), the total amount is due immediately. 4. Prices The prices stated in the contract are final prices and include the legally applicable VAT. Additional costs (e.g. for final cleaning or pets) are clearly stated during the booking process. 5. Arrival and departure The holiday apartment is available from 3 p.m. on the day of arrival. On the day of departure the holiday apartment must be vacated by 11 a.m. at the latest. A later departure requires the express consent of the landlord and may incur additional costs. 6. Withdrawal and cancellation The tenant can withdraw from the contract before the start of the rental period. Cancellation must be made in writing or by email. In the event of cancellation, the following conditions apply: Up to 30 days before arrival: free cancellation Up to 14 days before arrival: 50% of the total amount Less than 14 days before arrival or in the event of a no-show: 100% of the total amount Should the landlord succeed in renting the holiday apartment to someone else for the canceled period, the proceeds will be refunded less a processing fee of €50. 7. Use of the holiday apartment The holiday apartment may only be used by the number of people stated in the booking. Use for other purposes (e.g. commercial use, events) is prohibited unless there is express written permission from the landlord. The tenant undertakes to treat the holiday apartment carefully and to report any damage caused by him or his companions to the landlord immediately. 8. Pets Pets may only be brought with the prior written consent of the landlord. An additional amount may be charged for this, which will be shown in the booking process. 9. Liability The landlord is not liable for loss or damage to items brought in by the tenant, unless the damage was caused by gross negligence or intent on the part of the landlord. The landlord is only liable for damage caused by the use of the holiday apartment if this is due to intent or gross negligence. 10. Data protection The tenant's personal data will be used exclusively to process the contractual relationship and will not be passed on to third parties unless this is necessary to fulfill the contract or required by law. 11. Final provisions German law applies. The place of jurisdiction is, as far as legally permissible, the registered office of Noahkis Apartments GbR. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. In such a case, the invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision.
